These terms form the agreement between you and us for your use of Memo Butler ("the App"). By downloading or using the App, you agree to them. If you do not agree, please do not use the App.
The App is made and published by an independent individual developer ("we", "us", "our"). We are a one-person effort, not a company with a support department, and these terms are written with that in mind. You can always reach us at support@memobutler.com.
Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on any Apple device that you own or control, in accordance with Apple's Licensed Application End User License Agreement and the App Store's Usage Rules. This licence covers your own personal, lawful use and no other.
Apple's role
This agreement is between you and us alone — Apple is not a party to it. Apple is not responsible for the App or its content, and has no obligation to provide any maintenance or support for it. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. We, not Apple, are responsible for addressing any claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Your first month
New users receive a free first month with full features. This period is granted by the App itself from your first launch — no payment method, no purchase, and no commitment are required to begin. It is not an Apple free trial and is not billed through Apple.
Membership
After the first month, continuing to add new memories requires a membership. Reading and revisiting memories you have already created remains free at all times. Membership is offered as:
- Monthly — US$9.99 per month, auto-renewing.
- Yearly — US$99.99 per year, auto-renewing.
- Lifetime — US$200, a one-time purchase.
Prices are shown in US dollars; the amount charged in your local currency and any applicable taxes are determined by Apple and shown to you before purchase.
Auto-renewal and cancellation
Monthly and yearly memberships renew automatically at the end of each period unless you cancel at least 24 hours before it ends. Payment is charged to your Apple ID at confirmation of purchase, and your account is charged for renewal within 24 hours before the current period ends, at the price of the plan you chose. You can manage or cancel at any time in your device's Settings → Apple ID → Subscriptions; cancellation takes effect at the end of the current period. The lifetime membership is a one-time purchase and does not renew.
Refunds
All purchases and refunds are handled by Apple in accordance with App Store policies. We are not able to process payments or issue refunds directly. Requests should be made to Apple through your purchase history.
Your memories
If your membership lapses, we never delete or withhold your existing memories. The App simply becomes read-only for new entries: everything you have already created remains on your device and fully readable. Your content is stored on your device — and, if you choose, in your own device backups, which stay under your control (see our Privacy Policy).
A personal keepsake
Memo Butler is a diary for keeping and revisiting your own memories, for personal enjoyment. It is not a medical, safety, financial, legal, or professional tool, and it is not a substitute for professional advice or for your own judgement. Anything the App helps you remember is a reminder of what you have chosen to record — the responsibility for what you record, and for any decision you make, remains yours.
Your responsibilities
You are responsible for how you use the App, for the content you create in it, and for keeping your own backups of your device. You agree to use the App only for lawful, personal purposes, and — to the extent permitted by law — to hold us harmless from any claim arising out of your unlawful or improper use of the App.
Intellectual property
The App — including its design, text, artwork, and software — is our property and is protected by copyright and other intellectual-property laws. Your licence does not transfer any ownership to you.
Acceptable use
Please use the App only for personal and lawful purposes. Except to the extent this restriction is prohibited by applicable law, you agree not to reverse-engineer, decompile, tamper with, or otherwise misuse the App.
Disclaimer and limitation of liability
To the fullest extent permitted by law, the App is provided "as is" and "as available", without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss of data, arising from your use of the App; and our total liability to you shall not exceed the amount you have paid for the App. Because your content is stored only on your device, we recommend keeping your own device backups. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities, so some of the above may not apply to you, and nothing in these terms limits any rights you have under mandatory consumer-protection law.
General
These terms, together with our Privacy Policy, are the entire agreement between you and us regarding the App. If any provision is found unenforceable, the rest remains in full effect. Our not enforcing a provision on any occasion is not a waiver of it.
Changes
We may update these terms from time to time; the current version will always be posted on this page with its effective date. Continued use of the App after an update means you accept the revised terms.
